1. General Provisions

1.1. This offer (hereinafter referred to as the "Agreement") is the official proposal of the owner of the gpt-open.ru service (hereinafter referred to as the "Operator") to enter into an agreement on the terms set forth below.

1.2. The user who registers on the gpt-open.ru website and uses its services accepts the terms of this Agreement (hereinafter referred to as the "User").

2. Subject of the Agreement

2.1. The Operator provides the User access to an online service for communication with the neural network, generating images, and other functions such as attaching images and documents (hereinafter referred to as the "Service").

2.2. Services are provided under the terms of the tariff plan selected by the User.

3. Terms of Use

3.1. The User agrees to use the Service solely for lawful purposes and to comply with all applicable laws and regulations.

3.2. The Operator reserves the right to restrict or terminate the User’s access to the Service in the event of a violation of the terms of this Agreement.

4. Tariffs and Payment

4.1. The Service offers three tariff plans:

— Three-month: 3450 rubles

— Monthly: 1500 rubles

— Two-week: 900 rubles

4.2. Tariff plans and their prices may be changed by the Operator unilaterally.

4.3. Payment is made by bank card through the integrated payment system.

4.4. Paid services are non-refundable, except in cases provided for by the legislation of the Russian Federation.

4.5. Refunds.

4.5.1. Refunds for services are made only in cases of non-provision or improper provision of the Service by the Operator.

4.5.2. The User is entitled to a refund if the Service becomes unavailable for more than 72 hours during the current tariff period.

4.5.3. The Operator undertakes to consider the refund request within a reasonable time and notify the User of the decision.

4.5.4. In case the refund request is approved, the purchase amount will be returned to the User’s specified bank account within 10 working days.

4.5.5. Please note that refunds can only be made if the following conditions are met:

— Compliance with the requirements set forth in this Agreement and additional conditions established by the Operator at the time the Service is provided.

— Providing the User with sufficient information and confirmation of the grounds for the refund, including documentary evidence if necessary.

4.6. Payment Methods.

4.6.1. Payment for the selected tariff plan must be made by the User before its use or at the time of ordering through the integrated payment system.

4.6.2. Accepted payment methods include bank cards, electronic payment systems, and other agreed methods listed on the gpt-open.ru website.

5. Confidentiality and Data Protection

5.1. The Operator is committed to taking all necessary measures to protect Users’ personal data, including using modern encryption methods.

5.2. Users’ personal data is processed in accordance with the Privacy Policy published on the gpt-open.ru website.

5.3. The Operator does not transfer Users’ personal data to third parties without their consent, except in cases provided for by the legislation of the Russian Federation.

6. Liability of the Parties

6.1. The Operator undertakes to ensure the operability of the Service and provide technical support to Users.

6.2. The Operator is not liable for temporary failures and interruptions in the Service due to technical reasons but undertakes to take all possible measures to eliminate them.

6.3. The User bears full responsibility for the accuracy of the data provided and for compliance with the terms of this Agreement.

7. Miscellaneous

7.1. The Operator has the right to unilaterally amend the terms of this Agreement. Amendments take effect from the moment they are published on the gpt-open.ru website.

7.2. In the event of disputes, the parties undertake to resolve them through negotiations. If the dispute cannot be resolved through negotiations, it shall be subject to judicial consideration at the location of the Operator.

7.3. This Agreement comes into force from the moment of acceptance by the User and is valid until the termination of the use of the Service.
